Disability Discrimination Attorney — Orange County

California law requires employers to provide reasonable accommodations to employees with disabilities and prohibits discrimination based on physical or mental disability. If your employer failed to accommodate your disability, denied you leave, or terminated you because of a medical condition, you may have a viable claim under FEHA.

What Is Disability Discrimination?

Disability discrimination occurs when an employer treats an employee unfavorably because of a physical or mental disability. California's definition of disability under FEHA is broader than federal law and covers a wide range of physical and mental conditions that limit a major life activity.

Failure to Accommodate

Employers with five or more employees are required to provide reasonable accommodations to employees with disabilities unless doing so would cause undue hardship. Reasonable accommodations may include modified work schedules, leave of absence, reassignment to a vacant position, or modification of workplace policies.

The Interactive Process

When an employee requests an accommodation, California law requires the employer to engage in a timely, good faith interactive process to determine an effective accommodation. Failure to engage in the interactive process is itself a violation of FEHA.

What You May Be Entitled To

If your employer discriminated against you based on disability or failed to accommodate you, you may be entitled to recover lost wages and future earnings, emotional distress damages, punitive damages in cases of malicious conduct, and attorney's fees and costs.
