LAW OFFICES OF BRIAN M. BROWN

Wage and Hour Attorney — Orange County

California has some of the strongest wage and hour protections in the country. If your employer has failed to pay you properly, denied you meal or rest breaks, or misclassified you as exempt or independent contractor, you may be entitled to significant compensation.

Common Wage and Hour Violations

California wage and hour violations include unpaid overtime, failure to pay minimum wage, missed or interrupted meal and rest breaks, off-the-clock work, improper tip pooling, failure to provide accurate wage statements, and misclassification as an independent contractor or exempt employee.

California Overtime Law

Non-exempt employees in California are entitled to overtime pay at one and one-half times their regular rate for hours worked over eight in a day or forty in a week, and double time for hours worked over twelve in a day. Many employers misclassify employees to avoid paying overtime.

Meal and Rest Break Violations

California employees are entitled to a thirty-minute unpaid meal break for shifts over five hours and a ten-minute paid rest break for every four hours worked. Employers who fail to provide these breaks owe employees one additional hour of pay per missed break.

What You May Be Entitled To

If your employer violated California wage and hour laws, you may be entitled to recover unpaid wages, interest, waiting time penalties, civil penalties, and attorney's fees and costs.
